This has turned out to be something of an active day for information flowing my way. First, I find out that Deric has been transferred to a new jail and then I find out that the Atty for Alexandra Goddard and Thomas Olsen has notified the court that he will no longer represent them. To top things off, I find out that Thomas Olsen is suing Michelle McKee which turns out to be the primary reason that Mr Gibson withdrew from their case.

This development now gives a long shot chance that Deric may prevail if the lawsuit goes forward. The motion to dismiss Deric’s lawsuit has yet to be ruled upon. IF the court dismisses the civil lawsuit, then the case may be at an end.

If, however, the court does allow the lawsuit to go forward, the dispute between Olsen and McKee may give Deric a better chance to prevail.

    Where is the lawsuit for this new case? Is it federal court?

      Yes, it is in federal court out of the state of NC. Right now it is on hold pending a ruling on jurisdiction. Michelle McKee has been dropped from the lawsuit and is in turn filing for damages and court expenses.

    Olsen managed to have the attorney defending him, Goddard & McKee file a motion with the court to withdraw from being their attorney to defend against Lostutter’s lolsuit because Olsen was stupud enough to file for a protective order against McKee his co-defebdant. In an attempt to stick it to McKee, Olsen single handedly forced their defense attorney to withdraw from the case. This is both pure stupidity & funny as hell. Who does Goddard & Olsen think is going to defend them now? Picazio? She’s no doubt the rocket scientist who convinced Olsen to file against McKee in the 1st place. McKee is free and clear, while Goddard & Olsen’s retribution against McKee only resulted in them being forced to defend themselves against their own online games of fuckery. Good for McKee for removing herself from this stupid lawsuit and leaving her codefendants to clean up their own mess.

      If I remember the timeline correctly, McKee filed her action before any protective order was considered by Olsen. Deric had removed Michelle from the lawsuit and some time later she filed for recovery of atty fees and punitive damages.

      What is rather odd about this whole thing is that Deric prepared the answer to Michelle on April 10th according to the date of the notary stamp. When he filed with the court, the dates put on the document were April 20th. What I do not understand is why the notary would have stamped an undated document.

    Clearly Murt has a great deal of courtroom experience and he knows what he is talking about.

    Oh, wait a minute…..

    Gibson cannot “quit”. Lawyers are not allowed to “quit”. They can withdraw, but ONLY if a judge allows them to (which they usually do like 90% of the time).

    This “development” will have no effect on the outcome of this case. Even if the judge did have a ‘senior moment’ and denied the motion to dismiss, how the fuck do you think Lostutter could take it to trial? He’s in fucking federal prison!!! The court is not going to allow him a bench warrant so Lostutter can have his Perry Mason moment.

    Lostutter’s wife getting her finger prints all over this case will only result in her getting body slammed by the judge. But she is a nigger, after all, and no one ever accused a nigger of having too much sense. So whatever.

    Olsen seems like a flake and he, too, will get body slammed by the judge in Florida. But that is what happens when a moron thinks he is an attorney.

    All McKee needs to do is write a nice letter to the trial court making a point to mention that she has never been in Florida and has never had any kind of in-person contact with Olsen, and mention that Florida has absolutely no personal jurisdiction over her, citing the case Walden v. Fiore, 134 S.Ct. 1115 (2014), and then point out that David v. Textor, 189 So.3d 871 (Fla. 4th DCA 2016) absolutely PROHIBITS the trial court from granting Olsen a restraining order based upon what he claims happened.

    She can do this all from the comfort of her own home.

    Filing lawsuits is tricky business best left to experts. Filing lawsuits against people across state lines is even more tricky and many so-called lawyers haven’t a clue as to how to properly do this.

      On my use of the word “quit.” It is true that a lawyer cannot quit in the strict sense of the word but has to file a motion to withdraw which is normally granted. The motion amounts to the same thing since the lawyer wants no part of the case and wants out. Not everyone who reads here or other blogs knows the nuances of the how things are done in the legal process and most who read the article will come to the conclusion that the lawyer quit as well.

      This is not a legal journal. It is a blog. Not everyone is interested in the minute details of the legal system. For most, the term “quit” will suffice. I also include court documents in this kind of article so that the reader can read exactly what was done and the legal terms used.
